Supplementary Planning Guidance (SPG)

The Supplementary Planning Guidance (SPG) listed below is non-statutory local authority approved guidance which supplements the Joint Unitary Development Plan (JUDP) for Pembrokeshire. SPG may be taken into account as a material consideration in terms of determining planning applications. All of the SPG below has been prepared in consultation with the public and has been the subject of a Council resolution.

Pembrokeshire Affordable Housing Delivery Statement  (October 2009) 

Pembrokeshire County Council and the Pembrokeshire Coast National Park Authority have jointly prepared an Affordable Housing Delivery Statement (AHDS). Following a 6 week public consultation, this Statement was agreed by the Council's Cabinet on 5 October 2009 and by Full Council on 22 October 2009, upon which it became adopted.

The statement sets a target for delivering affordable housing up to 2011 and is a material consideration that should be afforded significant weight when determining planning applications for housing and in dealing with such proposals at appeal.

The AHDS can be viewed at:

· The National Park Offices at Llanion Park, Pembroke Dock
during normal office hours. It is also available to view and download below. Paper copies will be supplied on request.

Principles of Good Design in Residential Development (October 2008)

Supplementary Planning Guidance (SPG) entitled ‘Principles of Good Design in Residential Development’ was formally adopted by Pembrokeshire County Council on 6th October 2008. The SPG provides a formal basis for assessing design on all residential planning applications. Anyone applying for planning permission for residential development should therefore adhere to the 10 principles of good design outlined in this document in order to achieve high quality design standards.

The consultation report describes how and who we consulted on the SPG and is accompanied by a response and comments received during the public consultation.

Safeguarding Coal Reserves in Pembrokeshire (February 2007)

Supplementary Planning Guidance (SPG) entitled ‘Safeguarding the Coal Resource in Pembrokeshire’ was formally adopted by Pembrokeshire County Council on 5 February 2007. The SPG identifies a safeguarding zone in which permanent development will be prevented in order to preserve the coal resource in the County for future extraction, if it is required. It also provides advice for applicants seeking permission for coal development, including constraints to such development and the type of planning conditions that may be attached to a decision. Anyone applying for planning permission for development within the safeguarding area, or applying for planning permission for coal related development should take account of this advice.

Building in a Sustainable Way (December 2005)

This Guidance should be read by anyone wishing to submit a planning application for new build and refurbishment and alterations to existing buildings. Appendix 2 contains a checklist that should be completed by applicants and submitted with their planning application to show how they have taken account of the Guidance.

Low Impact Development - Making a Positive Contribution (June 2006)

This SPG sets the context for considering proposals for low impact development including the information the Council will require to assess a planning application and arrangements for monitoring permitted schemes. Biodiversity and Development in Pembrokeshire (March 2007)

Supplementary Planning Guidance entitled ‘Biodiversity and Development in Pembrokeshire’ was formally adopted by Pembrokeshire County Council on 12th March 2007. The SPG provides advice on the consideration of biodiversity for applicants seeking permission for development. The Natural Environment and Rural Communities Act (NERC) 2006 places a duty on all public authorities, including Local Authorities, to have regard for and conserve biodiversity in exercising all of its functions.

Slade Lane, Haverfordwest, Design Statement and Code

This item of Supplementary Planning Guidance provides additional detail on the way in which the JUDP’s proposals to develop housing on two sites in Haverfordwest (to the south and north of Slade Lane respectively) might be implemented.

Planning Obligations (May 2009)

On 18 May 2009, Cabinet agreed that as from 1 September 2009 the Transportation Planning Obligation would be sought on new residential developments with a net gain of 3 or more dwellings. (Pembrokeshire Coast National Park Planning Authority made a similar commitment). Please see attached Minute for specific details. Economy Overview and Scrutiny Committee has been charged with the task of looking further into the planning obligations to be attached to Education, Waste and Recycling, Open Space, and Libraries and Community Facilities.

Supplementary Planning Guidance Position Statement

At the time that the Joint Unitary Development Plan for Pembrokeshire (JUDP) was prepared, it was anticipated that there would be sufficient time between plan adoption and commencement of work on a successor plan to prepare a substantial programme of Supplementary Planning Guidance (SPG) to support the JUDP. However, all Local Planning Authorities in Wales now have to prepare Local Development Plans (LDPs) and the Welsh Assembly Government is pressing Authorities across Wales to move to the new LDP system as rapidly as possible. To make progress with this new plan in accordance with the recently agreed LDP Delivery Agreement will require considerable staff time and financial resources.

In that context, it is no longer realistic to prepare the full programme of SPG envisaged by the JUDP and a scaled-down programme is therefore now proposed. The opportunity has also been taken to clarify the status of earlier items of SPG, originally prepared to support the now superseded Local Plans.

The revised programme of Supplementary Planning Guidance preparation was approved by Cabinet on the 3rd December 2007.

Details of the new programme are set out below:

  • All SPG to support the superseded Local Plans is now withdrawn, excepting the four Conservation Area Character Statements (for Lamphey, Neyland, Llangwm and Goodwick Conservation Areas) and the two Conservation Area Maintenance and Management Plans (for Lamphey and Neyland Conservation Areas), which are retained as the Council’s response to Section 71 of the Planning (Listed Buildings and Conservation Areas) Act 1990.
  • The six items of JUDP SPG, already prepared, have been adopted by the Council and should be read in conjunction with the JUDP. These are:

- ‘Building in a Sustainable Way’;

- ‘Low Impact Development’;

- ‘Affordable Housing’;

- ‘Safeguarding Coal Reserves in Pembrokeshire’;

- ‘Biodiversity and Development in Pembrokeshire’; and

- ‘Slade Lane, Haverfordwest, Design Statement and Code’.

- ‘Design of Residential Development’;

  • Additional JUDP SPG will be prepared on the following basis:

High Priority:

- ‘Planning Obligations’;

- ‘Conversion of Traditional Buildings’;

- ‘Recreational Open Space’; and

- A development brief for the housing site in Haverfordwest between Shoals Hook Lane and the A.40 Bypass.

Medium Priority:

- ‘Car and Cycle Parking Guidelines’;

- ‘Guidance on Shop Front Design’;

- ‘Minerals’ (focusing on environmental issues associated with the development of mineral and waste sites); and

- ‘The Welsh Language’.
